PHOENIX — The tragic story of a San Carlos Apache tribal citizen, who was raped at a Phoenix healthcare facility and gave birth of a baby boy, became more convoluted on Thursday when it was revealed she has been in living at the facility since the age 3 — not for the past 14 years that was first reported when the story broke. First reports said she was involved in a near drowning accident then.
In court documents, it was disclosed she has been living there since age 3. The documents say the woman, a resident of Hacienda de los Angeles, is “not alert” and needs a “maximum level of care.”
Since giving birth, she is in a hospital near the baby boy, according local press reports.
Attorney John Micheaels
The woman’s family has retained the services John Micheaels. He is Phoenix-based attorney, who specializes in areas of medical negligence. Micheaels is currently listed in Best Lawyers in America for the 10th year in a row.
Michaeals released the following statement:
“The family obviously is outraged, traumatized and in shock by the abuse and neglect of their daughter at Hacienda Healthcare. The family is well aware of the intense news and public interest in their daughter’s case, but at this time is not emotionally ready to make a public statement. The family would like me to convey that the baby boy has been born into a loving family and will be well cared for.”
Court documents further report, the woman weighs 112-pounds and is described as “incapacitated” and “unable to make any decisions or give consent due to her disability.” In the most recent recent medical report filed with the court, she is listed as having a brain injury, seizures, recurrent pneumonia and both feeding and breathing tubes. The report, filed in May, covered a one-year period from April 2017 to April 2018, documents show. Prior to the giving birth to the baby boy, she was last given a medical exam by a court-appointed physician on April 16, 2018, which indicated there was nothing unusual concerning her health.
On Tuesday, the Phoenix Police Department took DNA samples of male staffers to determine who the rapist is.
