Goldwater Institute to Announce Anti-Indian Child Welfare Act Lawsuit on Tuesday, July 7

PHOENIX— In yet another attack on the Indian Child Welfare Act, the Goldwater Institute, based in Phoenix, Arizona, will announce their intent to file an anti-ICWA class action lawsuit on Tuesday, July 7, 2015, at 9:00 a.m. – Pacific Time.

From preliminary information available, the lawsuit will inaccurately claim that the Indian Child Welfare Act is a race-based law that discriminates against American Indians and Alaska Natives.

The Indian Child Welfare Act (ICWA) is a federal law that was passed by Congress that seeks to keep American Indian and Alaska Native children with American Indian and Alaska Native families. Congress passed ICWA in response to the alarmingly high number of Native children being removed from their homes by both public and private non-Native agencies.

The National Indian Child Welfare Agency (NICWA), based in Portland, Oregon, seeks the support of all concerned parties in Indian Country and its allies to watch this important press conference. The news of this online press conference should be shared with tribal leaders, tribal attorneys’ offices, tribal child welfare departments, and others.

It is vital that all of Indian Country stay informed of these attacks on ICWA so that, together, we can work to uphold the protections that we have worked so hard to keep.
